Terms and Conditions of Booking

The Fine Travel Company ("FTC") is registered with the British Columbia, Canada, Registrar of Travel, License No.: 3743-5.

We endeavour to ensure that all our customers have complete satisfaction no matter what their requirements are. It should be understood that we are acting on behalf of both you the customer and the supplier of the travel products specified. The following terms and conditions apply to all bookings:

1. FTC will act as both your agent and as the agent of the Operator and will endeavour to provide travel products and services that meet your requirements.
2. All bookings and arrangements made by FTC are subject to the terms and conditions of the FTC as specified in this agreement and as imposed by law except when special requirements/terms and conditions of the Operator concerned are outlined in a proposal, offer, quote and confirmation. FTC shall have no liability to you in connection with the travel products except as specified in this agreement and as imposed by law.
3. Unless otherwise stated you will pay a deposit of 10% of the total cost of your travel (incl. taxes) or a minimum of $200.00 per person (non-refundable booking fee) to FTC.
4. The deposit must be paid within 5 calendar days of your booking. If the deposit is not paid within 5 calendar days of your booking, your reservations will be cancelled. If, after payment of the deposit, you cancel your booking at least 61 days prior to the commencement the deposit will be fully refunded as it exceeds the non-refundable booking fee of $200.00 per person.
5. After your booking FTC will send to you an invoice / receipt as your final account. No further reminders regarding payment will be sent to you.
6. Unless otherwise stated you must pay the full ticket price for the booked vacation to FTC at least 60 days prior to the commencement of your vacation package. If the full ticket price is not paid within the stipulated time, your reservations will be cancelled and the full amount of your deposit will be forfeited to FTC.
7. If you cancel your booking or any part thereof, after your payment of the ticket price your refund will be as follows unless a specified cancellation policy of an operator applies:
   
   - If cancellation notice is received between 60 and 50 days prior to the commencement of your vacation package your refund is 75% of the total ticket price.
   - If cancellation notice is received between 49 and 36 days prior to the commencement of your vacation package your refund is 50% of the total ticket price.
   - If cancellation notice is received between 35 and 32 days prior to the commencement of your vacation package your refund is 25% of the total ticket price.
   - If cancellation notice is received within 31 days of the commencement of your vacation package you will forfeit the full ticket price to FTC.
    
8. FTC will only issue tickets, vouchers and the like after receipt of payment of the full amount due to in respect of the facilities booked.
9. You will pay to FTC a fee of $50.00 for each and every change in booking per person after the ticket price is paid by you.
10. It is your responsibility to arrive at all departure points at the times specified in the tickets, vouchers or itineraries supplied by FTC.
11. FTC does not accept responsibility for the consequences of your late arrival or non-arrival to the destinations contemplated in this agreement.
12. You are responsible for the provision of all the necessary travel documents including visas, health requirements, international driver's licenses, certifications and the like.
13. FTC reserves the right not to accept bookings if you are not adequately insured against such holiday or travel risks as it may from time to time specify.
14. FTC encourages you to insure you and your dependents with special travel, health, liability and accident insurance to secure your needs in case of any loss or damage to yourself and others.
15. Any complaints in respect of travel products and services offered by or through FTC must be received by FTC within four weeks after the end of your vacation otherwise any claim by you will be void. Complaints by you to FTC must be given in writing (registered letter) and/or via telefax to FTC. You will be notified after reception of the documents. In case of doubt it is your obligation to provide evidence that you have made your written complaints to FTC in time. Any complaints in respect exclusively to operators products or services do not include a refund of the agency fee for the FTC of 10%.
16. FTC makes arrangements with operators, hotels and other parties to provide you with the travel products and services you purchase. Although we take care in selecting these suppliers, we have no control over them and, therefore, cannot be responsible for their acts or omissions.
17. FTC will not be responsible for any loss, damage or injury, whether physical or mental, or to property, resulting from any delay, substitution or deficiency of quality of equipment or service, or any act, omission, negligence or commission of any party supplying any of the products or services herein, its agents, servants, employees, subcontractors or for any claims for such loss, damage, or injury, whether physical or mental, arising there from, or from any cause that arises by reason of the actions of any such parties.
18. The liability of FTC for any loss or damage or injury, whether physical or mental, arising from its own acts, omissions or negligence, is limited to the total price of the products and services purchased by you excluding the 10% agency fee.
19. FTC reserves the right to cancel or make alterations to your itinerary for reasons of force majeure and there shall be no liability to FTC for such cancellations or alterations. "Force majeure" means circumstances where performance or prompt performance of the contract is prevented by reason of war or threat of war, riots, civil strife, industrial dispute, fire or adverse weather conditions and other similar circumstances beyond the control of FTC and the Operators.
20. You hereby grant to FTC the right to use any photographic material taken during the course of the events contemplated in this agreement. Such photographic material may be used for future advertising, web sites and brochures. Any objection to the later should be given in writing to the FTC no later than 4 weeks after the end of the event you attended.
21. All dates and times contemplated under this agreement will be calculated according to the worldwide standard for time (i.e. Universal Time Coordinated, Greenwich mean time, World time).
22. This agreement will be governed according to the laws of the Province of British Columbia and the Federal Laws of Canada and all disputes will be resolved in Vancouver, British Columbia.
23. The prices quoted are outlining the currency for the products. All prices must be paid in Canadian dollars. Some products are priced in others than Canadian currency. In this case payments are converted into Canadian dollars based on the official daily exchange rate.
24. Please note that the receipt of payment is defined by the time the payment is credited to the FTC trust account. We encourage you to review the timing of your payment with your bank. Please allow credit card payments at least 24 hours to be processed on the account.
25. Methods of payment and surcharges:
    Deposits and final payments may be made by Visa, Master Card, money order, cheque or wire transfer:
    - If paying by cheque, all cheques must be certified by the issuer’s bank.
    - If payments are made by bank wire transfer, notice of the dollar amount of wire transfer must be communicated to FTC prior to sending (by phone or email). Please confirm bank account details (Trust Account) with FTC prior to sending. The following surcharges apply to wired funds: amounts less than CDN$5,000 add $15; amounts in excess of $5,000 add $30.
    - If payment by credit card an additional surcharge of 4% will apply and charged from your credit card provided with the amount due.
